Family Code: justice and rationality

The search for a sense of justice and rationality to solve the problems of the Cuban family constitutes one of the great purposes of the new Family Code, highlighted on Tuesday by Leonardo Pérez Gallardo, president of the Scientific Society of Civil Law and Family.
At the Tony Alomá primary school, residents of the communities of Aduana and Nuevo Holguín met to debate on the relevance of approving a legal norm that, for the first time in Cuba, allows coexistence of “law and love".
Pérez Gallardo pointed out that it is a law that must be read with the eyes of the heart, because in the document a citizen can find issues that he likes and others that he does not, but this does not mean that another person does not need this legislative path for the realization of a life project.
He referred among the terms that have generated the greatest social concern is the substitution of Parental Authority for Parental Responsibility, a change that does not cause any damage to the duties and rights of fathers and mothers, especially because it is about rights that they acquire based on their children and whose responsibility, beyond legal, is moral.
The protection of the elderly in an increasingly aging society that faces a strong wave of migration of young people of childbearing age, makes a Family Code that seeks alternatives linked to aging even more relevant, grants the family caregiver the protection it deserves and offers the possibility to the elder to revoke his donation as punishment for the ungrateful, he explained.
Same-sex marriage, adoption and the inclusion of the terms Progressive Autonomy, which at no time should be confused with “permissibility,” were other issues addressed by Pérez Gallardo on in his speech.
Eliecer Peña, a psychologist by profession and a resident of La Aduana community, said that it is a paradigm shift that seeks to put an end to cultural leftovers, a modern code that leaves aside personal ambitions, and stressed that there is no better time than now to approve the regulations, because in times of material shortages, it should not be added affective and social problems whose solution is included in the Family Code.
